Our justice system is a sad operation indeed. It is true that we must have some way to weed the criminals form our society. However our justice system as we know it today fails miserably..
The jury system we have is a pitiful mess. People are chosen and assigned to jury duty with no knowledge of what is to take place in front of them..
What most do not realize is that the prosecution and the arresting officer(s) have the little show all set up.. They have already rehearsed it. The person on the witness stand knows exactly what the prosecutor will ask them next and exactly what they are supposed to answer..
What is wrong with that one might say.. We will explore that a little deeper a little later..
Most jurors have no idea that what they are looking at is a well rehearsed play.. The two attorneys will put on a show for them. Whoever puts on the best show will win the match most of the time.. Many times it is like a game between the prosecutor and the defense attorney. Each is trying to put another notch in his belt..
People who must serve on our juries have the right to know what is going on, but they haven't been told for all these hundreds of years and it is not likely that they ever will be.. They should have to attend classes and understand the procedures that they are about to witness before they should even be considered for jury duty..
And to add to the shame of the matter, some defense attorneys do not really try to get their clients off. Especially the Public Defenders who will get paid win or lose..
Now let us look into a case to understand what could happen.. You are on jury duty.. A fellow had been charged with vagrancy.. You can see him sitting in the courtroom.. You notice that he has a beard and and apparently hasn't shaved in weeks.. He has long hair down over his ears and reaching over his collar.. He is wearing what appears to be well worn sandals and no stockings.. He is told to take the witness stand and the questioning begins..
Sir, will you please state your name?He states a name but it was so low that you could hardly hear it.. He was told that he would have to speak louder..Sir, are you employed at this time?The defendant answers....
I am on my way to...The prosecutor states....Just answer yes or no sir...The defendant complies...NoSir do you have any money in your possession at this time?NoIs it true that you had no money when arrested?Yes..Sir, our officers have had you under surveillance for several days prior to your arrest.. Is it not true that even though you have no money and no visible means of support, that you partake of alcohol several times a week?Yes but I...Just answer yes or no please..YesSir, in the days prior to your arrest you were observed hanging out places and with people of undesirable character.. For example, the suspected crack house over on Sycamore street and the winery down on cherry street. Not to mention, several houses which are suspected of making meth? Is this not true?Yes but you see I...Sir, I have told you to just answer the questions with a simple yes or no!Yes.Sir we took the liberty of running a background check on you.. This check revealed that you have not been gainfully employed for over two years. Would you consider this report to be correct?YesAnd the prosecutor addresses the jury...Ladies and Gentlemen of the jury.. The defendant has been charged with vagrancy.. As you have been shown in this court room that he has no place to reside.. He has no money in his possession and did not have any when arrested.. He does not deny that he partakes of alcohol on a regular basis even though he is unemployed.. One would wonder exactly how he is able to do this.. It was brought out that he frequents places where drugs are sold.. He is not being charged with the sale of drugs, but one can't help but wonder where he gets his money...
Ladies and Gentlemen, we have proved beyond a reasonable doubt here today that this man is indeed guilty of vagrancy.. It is now your duty to examine the facts and render your verdict..

It would be only natural based on what was brought out at the hearing to assume that the defendant is without a doubt guilty of at least vagrancy and who knows what else that was not brought out?
It is your civic duty to discuss this case with the other jurors and decide his fate. That shouldn't be too hard to do and maybe you can get out in time to go out for dinner.. Think it over..
